Diese Datenschutzerklärung informiert Sie darüber, welche Personendaten wir im Zusammenhang mit der Nutzung unserer Website und unseres Produkts ChatPilot bearbeiten, zu welchem Zweck dies geschieht und welche Rechte Ihnen zustehen.

3. Wie wir Daten bearbeiten
Wenn Sie sich für ChatPilot registrieren, erstellen wir über Ihr Google-Konto automatisch eine eigene Google-Sheets- und Drive-Struktur, in der Ihre Konfigurations- und Konversationsdaten gespeichert werden. Wir fordern dabei ausschliesslich den eingeschränkten Zugriffs-Scope drive.file an — das heisst, unsere Anwendung kann nur auf Dateien zugreifen, die sie selbst für Sie erstellt hat, nicht auf Ihr übriges Google Drive.
Nachrichten, die Endkund:innen über WhatsApp an Ihren Bot senden, werden über die Meta/WhatsApp-Infrastruktur sowie unsere Server verarbeitet, um die konfigurierten Antworten zu liefern und die erfassten Daten in Ihr Sheet zu schreiben.
4. Externe Dienstleister
- Meta / WhatsApp — Übermittlung der Chatnachrichten (Meta Platforms Ireland Ltd.)
- Google — Speicherung Ihrer Bot-Daten in Sheets/Drive, Anmeldung via Google OAuth
- Resend — Versand von System- und Benachrichtigungs-E-Mails
- Hetzner Online GmbH — Hosting unserer Server (Rechenzentren in Deutschland)
Mit diesen Anbietern bestehen entsprechende Vereinbarungen bzw. gelten deren eigene Datenschutzbestimmungen für die jeweils übermittelten Daten.
5. Aufbewahrungsdauer
Wir bewahren Daten so lange auf, wie dies für die Erbringung unserer Leistung erforderlich ist oder gesetzliche Aufbewahrungspflichten bestehen. Bei Kündigung Ihres Kontos werden Ihre Konfigurationsdaten auf Wunsch gelöscht, sofern keine gesetzliche Aufbewahrungspflicht entgegensteht.
6. Ihre Rechte
Nach Massgabe des Schweizer Datenschutzgesetzes (DSG) sowie — soweit anwendbar — der EU-Datenschutz-Grundverordnung (DSGVO) haben Sie das Recht auf Auskunft, Berichtigung, Löschung und Herausgabe Ihrer Daten sowie das Recht, eine erteilte Einwilligung zu widerrufen. 7. Haftungsausschluss
Swiss Cactus befindet sich in der Beta-Phase. Wir bemühen uns um einen zuverlässigen, sicheren Betrieb, können jedoch keine ununterbrochene Verfügbarkeit, Fehlerfreiheit oder den permanenten Schutz vor Datenverlust garantieren. Soweit gesetzlich zulässig, übernehmen wir keine Haftung für direkte oder indirekte Schäden — einschliesslich entgangenem Gewinn, Geschäftsunterbrechung oder Datenverlust — die durch die Nutzung, Nichtverfügbarkeit oder Störung unserer Dienste, oder durch Ausfälle Dritter (u.a. Meta/WhatsApp, Google, Hetzner), entstehen.
8. Cookies
Unsere Website verwendet aktuell keine Analyse- oder Marketing-Cookies. Technisch notwendige Session-Daten werden ausschliesslich zum Betrieb der Anwendung (z. B. Login-Status im Dashboard) verwendet.

This Privacy Policy informs you about the personal data we process in connection with the use of our website and our product ChatPilot, the purpose of such processing, and your rights.

3. How we process data
When you register for ChatPilot, we automatically create a dedicated Google Sheets and Drive structure via your Google account to store your configuration and conversation data. We only request the restricted scope drive.file — meaning our application can only access files it has created on your behalf, not your entire Google Drive.
Messages sent by end customers via WhatsApp to your bot are processed through the Meta/WhatsApp infrastructure and our servers to deliver the configured responses and write the collected data to your sheet.
4. Third-party service providers

- Google — storage of your bot data in Sheets/Drive, login via Google OAuth
- Resend — sending system and notification emails
- Hetzner Online GmbH — hosting our servers (data centres in Germany)
Appropriate agreements are in place with these providers, or their own privacy policies apply to the data transmitted to them.
5. Retention period
We retain data for as long as necessary to provide our services or as required by statutory retention obligations. Upon cancellation of your account, your configuration data will be deleted on request, provided no legal retention obligation applies.
6. Your rights
Subject to the Swiss Federal Act on Data Protection (FADP) and — where applicable — the EU General Data Protection Regulation (GDPR), you have the right to access, rectify, delete and receive your data, as well as the right to withdraw consent. Please contact hello@swisscactus.com.
7. Disclaimer
Swiss Cactus is in beta. We strive for reliable and secure operation but cannot guarantee uninterrupted availability, error-free operation or permanent protection against data loss. To the extent permitted by law, we accept no liability for direct or indirect damages — including lost profits, business interruption or data loss — arising from the use, unavailability or disruption of our services, or from failures of third parties (including Meta/WhatsApp, Google, Hetzner).
8. Cookies
Our website does not currently use analytics or marketing cookies. Technically necessary session data is used solely for the operation of the application (e.g. login status in the dashboard).

We may update this Privacy Policy, in particular as we continue to develop our beta products. The current version is always available on this page.

3. Cómo tratamos los datos
Cuando se registra en ChatPilot, creamos automáticamente una estructura de Google Sheets y Drive a través de su cuenta de Google para almacenar su configuración y datos de conversación. Solo solicitamos el scope restringido drive.file — es decir, nuestra aplicación solo puede acceder a los archivos que ella misma ha creado en su nombre, no a todo su Google Drive.
Los mensajes que los clientes finales envían a su bot a través de WhatsApp se procesan a través de la infraestructura de Meta/WhatsApp y nuestros servidores para entregar las respuestas configuradas y escribir los datos recopilados en su hoja de cálculo.
4. Proveedores de servicios externos

Con estos proveedores existen acuerdos correspondientes o se aplican sus propias políticas de privacidad a los datos transmitidos.
5. Período de conservación
Conservamos los datos durante el tiempo necesario para prestar nuestros servicios o según lo exijan las obligaciones legales de conservación. Tras la cancelación de su cuenta, sus datos de configuración serán eliminados a petición suya, siempre que no exista obligación legal de conservación.
6. Sus derechos
De conformidad con la Ley Federal Suiza de Protección de Datos (LPD) y, en su caso, el Reglamento General de Protección de Datos de la UE (RGPD), tiene derecho de acceso, rectificación, supresión y portabilidad de sus datos, así como el derecho a retirar el consentimiento otorgado. 7. Descargo de responsabilidad
Swiss Cactus se encuentra en fase beta. Nos esforzamos por garantizar un funcionamiento fiable y seguro, pero no podemos garantizar una disponibilidad ininterrumpida, la ausencia de errores o la protección permanente contra la pérdida de datos. En la medida permitida por la ley, no asumimos ninguna responsabilidad por daños directos o indirectos — incluyendo lucro cesante, interrupción del negocio o pérdida de datos — derivados del uso, la no disponibilidad o la interrupción de nuestros servicios, o de fallos de terceros (entre otros Meta/WhatsApp, Google, Hetzner).
8. Cookies
Nuestro sitio web no utiliza actualmente cookies de análisis ni de marketing. Los datos de sesión técnicamente necesarios se utilizan exclusivamente para el funcionamiento de la aplicación (p. ej., estado de inicio de sesión en el panel de control).

Podemos actualizar esta Política de Privacidad, en particular en el marco del desarrollo continuo de nuestros productos beta. La versión actual siempre está disponible en esta página.
